Trade Act Penalty System modified

US Customs and Border Protection (CBP) has changed its fines policy for carriers that fail to submit electronic cargo information before arrival at the border. Under the new rule, carriers who can prove to CBP that they successfully submitted the required information to their US Customs brokers will not be penalized for non-compliance.

This is a victory for the Canadian Trucking Alliance (CTA),

"It was unfair of CBP to issue fines exclusively to carriers for failure to meet Trade Act requirements when carriers were submitting cargo information well in advance to their US
brokers. Carriers cannot control the information processes of Customs brokers and [this] announcement by CBP recognizes this lack of control," said David Bradley, CEO of CTA. … The fines ranged from US$5,000 to US$10,000 for repeat offenders.
